PERSONAL DATA PROTECTION POLICY

Map Pacific (Singapore) Co., Ltd (“MPS”) always respects the protection of customers’ personal data, not only to ensure customer trust, compliance with the law regulation but also to ensure national security. The following Personal Data Protection Policy is intended to inform all customers of Map Pacific (Singapore) Co., Ltd about the rights and content of the processing of personal data of data subjects that Map Pacific (Singapore) Co., Ltd collects through the company’s activities.

  1. Manage personal data

Customers refer to external clients and partners who have direct or indirect contractual relationships with MPS through business activities, including but not limited to: distributors, retail agents, farmers, business partners, and suppliers of goods and/or services, etc.

Customer agrees to allow MPS to collect, store, process and use personal data of Customer, personnel, representatives, customers of Customer, including but not limited to: Full name, address, date, month, year of birth, email, identity card number, citizen identification number, personal identification number, passport number, phone number, nationality and other other personal data (“Personal data of Customer”) for the purpose of performing the rights and obligations  in  mutual agreements of the Parties and according to the law. For the above purposes, Customer’s personal data may be transferred and processed outside of Vietnam’s territory. Personal data of Customer will be processed legally, transparently and in accordance with applicable laws. MPS will take necessary and measures in accordance with the law to secure Customer’s personal data within the scope and ability of MPS.

  • Process personal data

Customer has full capacity and is responsible for the legality of personal data provided to MPS under mutual agreements of Customer and MPS. Customer ensures that Customer obtains the consent of the personal data owners, regarding personal data can be provided to and processed and used by MPS, and Customer maintains that consent throughout the term of mutual agreements of Customer and MPS, for the purpose of mutual agreements of Customer and MPS and according to the law. Customer is obliged to provide MPS the evidence for the consent of the personal data owners, as soon as MPS requests at certain period of time during the mutual agreements of Customer and MPS and/or at the request of a state competent authorities

  • Customer’s commitment

Customer agrees to keep MPS from any third party’s claims, disputes, damages related to the collection, control, processing of personal data arising from or related to Customer’s breach of obligations under this policy and/or the law. If MPS is liable for any claim or damage related to this policy, Customer shall indemnify MPS for the respective damage.

  • Personal Data Protection Policy
    • Personal Data of Customer

MPS may collect and process the following types of personal information:

  1. Name, citizen identification number/identity card number/passport number, gender, date of birth, title;
    1. Place of birth, place of birth registration, place of permanent residence, temporary residence, current residence, hometown, contact address;
    1. Gender;
    1. Nationality;
    1. Contact information such as phone number, mailing address, email address, fax number; home address, mobile phone number, personal email address, bank account information;
    1. Communication between MPS and Customer;
    1. Call information, messages and call recording data arising during Customer’s use of the voice, message, and switchboard services of MPS;
    1. Image, audio and video data arising during Customer’s purchase goods, use MPS’s services;
    1. Images of individuals, including images provided when registering to purchase goods, use the service, images of Customer posted on MPS’s website, fanpage,… during the use of the service;
    1. Information about the individual’s digital account; personal data reflecting activities, history of activities on cyberspace;
    1. The data on telecommunications consumption behavior: call, sms, data;
    1. The other data provided by Customer to MPS when registering to purchase goods, use the service and also the data arising during Customer’s purchasing goods, using of the services of MPS.
  • Purpose of controlling and processing Personal Data

Customer agrees to allow MPS to process Personal Data of Customer and share the results of the data processing for the following purposes:

  1. Supporting Customer, updating Customer’s information when purchasing and using products and services provided by MPS or partners of MPS;
  2. Providing products, services of MPS, products, services of MPS in cooperation with partners to Customer;
  3. Organizing trade introduction and promotion, market research, opinion polls, brokerage;
  4. Researching and developing new services and provide suitable products and services for Customer;
  5. Trading in marketing services, introducing advertising products;
  6. Measuring, analyzing surface data, assessing and other processing to improve and enhance the quality of services, goods provided by MPS to Customer;
  7. Investigating and resolving Customer’s inquiries and complaints;
  8. Adjusting, updating, securing and improving the products, services that MPS is providing;
  9. Verifying the identity and ensure the confidentiality of Customer’s information;
  10. Notifying Customer about changes to the policies and promotions of the products and services that MPS is providing;
  11. Preventing fraud, identity theft and other illegal activities;
  12. Complying with applicable laws, relevant industry standards and other applicable policies of MPS;
  13. MPS collects, stores and uses personal data of Customer for the purpose of performing services such as record keeping and compliance with legal and tax obligations. MPS stores these data for a period of time or as required by law;
  14. Any other purpose exclusively for the operation of MPS and for any other purpose that MPS notifies Customer, at the time of collection of personal data by Customer or before the commencement of the relevant processing or as otherwise required or permitted by applicable law;
  15. Other cases for the purpose of performing transactions, contracts, agreements between MPS with Customer.
  •  Personal data storage time

MPS will store personal data provided by Customer on MPS’s internal system in the course of providing goods, services, performing the Contract or until the purpose of control or resolution is fulfilled, or until compliance with statutory obligations allows, and until the disputes (if any) are resolved.

  • Rights of Customer
  • The right to know and to agree;

Via this Policy, Customer becomes aware of MPS’s personal data processing activities. By signing contract with and buy goods from MPS, join MPS’s program, Customer expresses its will to agree with MPS’s processing of personal data.

  • The right to access;

Customer has the right to request MPS to confirm, at any time, that some of Customer’s personal data is processed by MPS, as well as request MPS to provide some information about the type of data to be processed, the purpose of processing and the recipient or category of recipients of such data.

  • The right to edit;

Customer has the right to request MPS to correct inaccurate or incomplete information relating to Customer.

  • The right to request data deletion;

Customer has the right to request the deletion of its personal data stored by MPS in accordance with applicable laws, for example when Customer’s personal data is no longer necessary for the purposes of the original collection, processing or when the Personal data of Customer is unlawfully processed.

  • The right to restrict processing of personal data;

Customer has the right to request MPS to limit the processing of Customer’s personal data without deleting the relevant data based on the conditions prescribed by applicable law.

  • The right to transfer data;

Customer has the right to recover some of its data for its own use or to transfer to another company/enterprise based on the conditions prescribed by applicable law.  

  • The right to object;

Customer has the right to object at any time to MPS’s processing of its personal data for direct marketing purposes.

  • The right to withdraw consent;

Where Customer’s processing of personal data is performed based on Customer’s prior consent, Customer has the right to withdraw consent at any time. However, withdrawal of consent will not affect the legality of prior processing of data based on Customer’s consent.

In the event that Customer withdraws its consent, MPS may not be able to provide Customer with the required quality and adequate goods, services if the withdrawn information directly affects goods, service delivery or goods, service quality.

  1. The right to complain, denounce or initiate lawsuits as prescribed by law;
  2. The right to claim compensation for actual damage in accordance with the law if MPS commits violations of regulations on protection of Personal Data, unless otherwise agreed by the partie otherwise agreed or otherwise provided by law;
  3. Method of exercising the right: in writing to MPS.
  • Obligations of Customer
  • Where Customer is an organization and has provided personal data of individuals related to or under the management of Customer to MPS, Customer shall ensure that it obtains the individual’s consent for the provision of their data;
  • Comply with the provisions of laws, regulations, instructions of MPS related to the processing of Personal Data of Customer;
  • To be solely responsible for the information, data and consents that they create and provide in the network environment; self-responsible in case personal data is leaked or infringed due to its fault;
  • Regularly update MPS’s Regulations and Personal Data Protection Policy from time to time, which is notified or posted on MPS’s Transaction Channel. Take actions in accordance with the instructions of MPS to express consent or disapproval for the purposes of processing Personal Data as notified by MPS from time to time.
  • Commitment on personal data protection
  • Personal data of Customer is controlled and processed in a lawful, fair, transparent and in accordance with applicable laws;
  • The Personal Data of Customer is collected for a specific, clear, lawful purpose and will not be processed other than the purposes stated in this Policy  and in accordance with applicable laws;
  • Customer’s personal data is stored appropriately and to the extent necessary for processing in accordance with applicable law;
  • Customer’s personal data is accurate and up-to-date; and the inaccurate data relating to the processing purposes will be promptly deleted or corrected in accordance with applicable laws;
  • MPS applies technical measures in accordance with applicable laws to ensure the appropriate level of security of personal data, including measures protection from unauthorized or illegal access to personal data and unintended destruction, loss or damage;
  • MPS guarantees and is solely responsible to its partners (service providers, other suppliers, customers, etc.) to also comply with the protection of personal data in accordance with the law;
  • MPS undertakes to comply with other principles prescribed by law regarding the protection of personal data, especially those relating to the rights of data owners and their obligations in transferring data to foreign countries;
  • MPS uses a variety of information security technologies to protect Personal Data from unintended retrieval, use or sharing. However, no data can be 100% secured. Therefore, MPS is committed to maximum security of Personal Data;

Some unintended consequences and damages may include, but are not limited to:

  1. Hardware and software errors in the data processing process cause data loss of Customer;
  2. The security hole is beyond MPS’s control, the system is attacked by a third party, causing data leakage;
  3. Customer self-discloses personal data due to: carelessness or fraud; visit websites/download apps that contain malware…

MPS recommends that Customer keep confidential information related to Customer’s account login password, OTP code and do not share this login password and OTP code with anyone else.

Customer should preserve the electronic equipment during use. Customer should lock, log out, or log out of the account on MPS website or app when there is no need to use it anymore.

In the event that it is known that the data storage server is attacked by a third party, leading to the loss of Customer’s Personal Data, MPS will be responsible for notifying the incident to the investigating authorities for timely handling and notify Customer.

  • General term
  •  
    • Customer understands and agrees that this Policy may be amended from time to time and communicated to Customer through MPS’s Transaction Channels. Changes and effective time will be updated and announced in the Transaction Channels and other channels of MPS. Customer’s continued use of the service after the notice period of amendments and supplements from time to time means that Customer has accepted such amendments and supplements.
    • Each Party has fully understood and agreed that this Policy is also the Notice of Personal Data Processing specified in current regulation on Protection of Personal Data and as amended and supplemented from time to time before MPS conducts Personal Data Processing. Accordingly, MPS does not need to take any other measures for the purpose of notifying the Processing of Personal Data to Customer.
    • This policy is publicly posted by MPS on the website for the mutual understanding of the Customer. The Customer agrees to have carefully read and understand their rights and obligations and agree to the entire content of the Policy. In addition, by purshasing goods, entering into the Contract(s), agreement or any other document to which this Policy is referenced, join MPS’s program, Customer undertake to agree or obtain the full consent of Data Subjects on the provision, processing and control of their Personal Data throughout the transaction process, contract performance and ensuring compliance and compliance with regulations on protection of personal data mentioned above in this Policy. This Policy is an integral part of the Contract(s), agreement or any other document to which this Policy is referenced.
